1. Acceptance of ViewMyLet terms & conditions

Access to and use of the services within ViewMyLet herein referred to as (the Website) is subject exclusively to these Terms and Conditions. You are prohibited from using the Website for any purpose that is considered to be unlawful or indecent or that which is prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website. We may update this policy from time to time and will notify registered users of any changes. A current Terms and Conditions policy will always be available on this website.

By registering with ViewMyLet, you are agreeing to be bound by these Terms & Conditions including the ViewMyLet:

2. ViewMyLet Service

ViewMyLet is not a letting agency and therefore does not take part in or have any responsibility for booking arrangements or any property management issues, claims or disputes between the property owner and those renting their property.

The website is a service provided purely as a means of showcasing property owners holiday homes on the internet, just as if they had their own dedicated website. However, access to the public pages is via a viewer passcode which is initially only disclosed to the property owner.

People wishing to rent a property will be able to contact the property owner via this website.

ViewMyLet cannot be held responsible for any failure on the part of the property owner and as such any failings are a matter between the property owner and the person renting their property. ViewMyLet will not become involved in any disputes.

Should a viewer feel that a property owner is in breach of the ViewMyLet Terms & Conditions or Privacy Policy, please provide precise details to:

3. Accuracy & appropriateness of information

All information contained within the property owner’s website pages is compiled and maintained directly by the property owner. Therefore, ViewMyLet do not warrant that any information provided is accurate.

Property owners must provide all information accurately and honestly and any images used must be the actual property, rooms and contents on offer.

Property owners must ensure that any information provided on their property website pages does not contain any indecent, racist, ageist, sexist or offensive material.

4. Legal matters

It is the responsibility of the property owner to ensure that the information provided is accurate, legal and decent and complies with any appropriate English law.

It is also the property owner’s responsibility to ensure that the information they supply does not breach any copyright or trade mark. ViewMyLet will not be held responsible for any such breaches.

5. Holiday home portfolio

Property owners need only register once. However, within their account they may add any number of properties. Any information provided must pertain to the exact property being offered and must not contain any hyper links, website addresses or reference to other properties not hosted on the ViewMyLet website.

6. Website links

To maintain the integrity of this website, property owners must not include any links to other websites or publish any e-mail addresses other than those which apply to that property and were provided during the registration process.

7. Copyright

All copyright, trade marks and all other intellectual property rights in the website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to ViewMyLet or otherwise used by ViewMyLet as permitted by law. This does not apply to the property owner’s text content and property images.

In using this website, you agree that you will access the content solely for your own use or that of your customers. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of ViewMyLet. This excludes the downloading of documents within the property owner’s account or property owner’s pages with a ‘print this tab’ facility.

Other than those that are downloadable from within your ViewMyLet account, you must not use the ViewMyLet logo on any electronic or printed documents.

8. Changes to ViewMyLet website

Because we take pride in our service and strive to continually improve for the benefit of ViewMyLet customers and potential customers of property owners, we reserve the right to:

Change or remove (temporarily or permanently) any part the Website without notice and that ViewMyLet shall not be liable to you for any loss resulting from such changes.

Change these Terms and Conditions at any time and your continued use of the Website following any changes shall be deemed to be your acceptance of such changes.

Where substantial changes or additions are made to the website, an email notification will be sent to registered users. It is therefore imperative that an active email address is recorded within your account. ViewMyLet will not be held responsible for clients claiming that they were not aware of such changes due to a non active or incorrect email address.

9. Links to third party websites

Any links to third party websites are intended for convenience purposes only. By providing them, ViewMyLet nor the property owners are making any specific recommendations and as such do not accept any responsibility whatsoever. Neither are endorsing any products or services. Users must satisfy for themselves that the information is correct and meets their needs.

10. Disclaimers and Limitation of Liability

ViewMyLet endeavours to make the website available on a continuous basis; however we cannot warrant the site will be available 24 hours a day.

The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

To the extent permitted by law, ViewMyLet will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of this Website.

ViewMyLet makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of ViewMyLet for death or personal injury as a result of the negligence of ViewMyLet or that of its employees or agents.

11. Indemnity

You agree to indemnify and hold ViewMyLet and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against ViewMyLet arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this website.

12. Severance

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

13. Property owner’s privacy obligations

Property owners must agree not to pass on to any third parties any personal information provided to them by their prospective customers.

Any communications between property owners and their prospective customers must be restricted to that which is necessary in dealing with their enquiry or queries.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.

15. Confidentiality

ViewMyLet will adhere to their Privacy Policy and will never disclose to any third party any personal information pertaining to property owners. Customers of ViewMyLet agree to the terms under this policy as part of the registration process.

16. Refund Policy

ViewMyLet has a Refund Policy and customers of ViewMyLet agree to the terms under this policy as part of the registration process.

17. Viewers’ passcode

ViewMyLet will never disclose property owners passcodes to any third parties. The only method a passcode can enter the public domain is where property owners chose to do so via verbal or printed materials.

18. Communication

ViewMyLet will normally communicate via email. It is therefore essential that property owners keep a current email contact on their ViewMyLet account. ViewMyLet can not be held responsible for loss of communication where the property owner fails to keep a current email address on their account.

19. Termination

In extreme cases ViewMyLet reserves the right to delete property information, either individual sections, pages or the entire property owner’s website.

Circumstances which may lead to such action being taken include but are not limited to persistent breaches of ViewMyLet terms and conditions, attempts to include unsuitable or deliberately inaccurate material or misuse of online systems. We may also terminate property listings if we receive a significant number of substantiated complaints relating to misrepresentation of a property or its surroundings. In such circumstances any payment made or remaining periods of paid subscription will be forfeited.

Property owners can at any time during the course of the period of their subscription on the website amend, suspend or permanently remove their property. This can be done via the users online account administration system. The ViewMyLet refund policy will apply.

ViewMyLet reserves the right to modify, amend or suspend any property owner’s information where it is deemed they are not adhering to these terms & conditions either in part or its entirety.

Property owners will receive a subscription renewal reminder by email 30 days before the property listing subscription expiry date, another 2 days before expiry and finally, if a subscription is not renewed, a notification explaining that un-renewed property subscriptions will be kept on the ViewMyLet system for a period of 30 days, however, property owners website pages will not be accessible on the internet. Once the 30 days after expiry has lapsed and the property listing subscription is not renewed, all the files associated with the property listing will be deleted from the user’s account.

Where a property owner has an account that does not contain any current and paid for property subscriptions, the account will be deleted after 30 days. Property owners will then be required to re-register if they wish to avail themselves of the services of ViewMyLet.

20. ViewMyLet logo

The use or reproduction of the ViewMyLet logo is restricted to those documents that are downloadable and printable from the ViewMyLet website. No other replication or use of the logo in part or in whole is permitted.

Any use of the logo other that that above will be considered as an infringement of copyright and legal action will be taken.
